To freelance in Portugal as an American or a Briton, you file a declaration of start of activity with the tax authority before you start, and the Social Security Institute then enrolls you in the independent workers regime from the information the tax authority passes on. From there you issue invoices through the tax authority’s system, declare your income to Social Security every quarter and file an income tax return each spring.

This is a spoke of our guide on working in Portugal as an American or a Briton, which sorts the work routes. Here we go through the self-employed side after you hold the right title. It is a reading of official pages, not legal or tax advice. We read the pages listed at the end on 18 October 2026. The most recent date among them is the “updated” line of the gov.pt guide on working for yourself, 28 September 2026; the page names no change, so the date marks when the page was last updated. The gov.pt page on opening activity was updated on 8 July 2026. The Social Security guide is its May 2025 version and prints 2025 amounts; where a 2026 figure is published we say so.

What do you need before you can freelance?

Two things come first: the right to work independently and a tax number.

For immigration, the AIMA page for the independent worker permit asks for a valid passport, a valid residence visa for independent professional activity, proof that you have started activity with the tax authority and with Social Security, and one of three things: a service contract, proof that a company was set up, or your latest receipts. The temporary permit is valid for two years and renewable for successive periods of three years. The visa side is in our D2 entrepreneur and independent worker visa guide.

AIMA’s page also says that the holder of an independent-work permit can take up employment by going to an AIMA shop, with an appointment, and asking for the residence title to be replaced.

You also need a Portuguese NIF, because the declaration of activity is filed with it. Our first month paperwork guide puts these steps in order.

How do you open activity with the tax authority?

The gov.pt page says that any independent worker or freelancer, full time or alongside a job as an employee, must open activity by filing a declaration of start of activity, before starting and at the latest on the day given as the start date. The Portal das Finanças FAQ says the people obliged to file are those who independently and habitually carry out production, trade or services.

The tax authority’s brochure on starting activity (dated March 2026) gives the practical steps:

  1. Log in to the Portal das Finanças with your NIF and password, or with the Citizen Card or the Digital Mobile Key, and go to Atividade, then submit declarations (start, change and end of activity). The FAQ adds that the declaration can also be made at any tax office, verbally, or at a Loja do Cidadão.
  2. Identify the activity code or codes you will exercise, taken from the list of activities in article 151 of the personal income tax code and the economic activity classification.
  3. Give the turnover you estimate until the end of the year. Only the period remaining in the year counts.
  4. Give the IBAN and BIC/SWIFT of a bank account in your name to link to the activity. A Portuguese bank account is the simple way to have one.

The FAQ says that for an individual without organized accounting the online filing depends on answering a questionnaire, and that the IRS and VAT regimes are then calculated automatically from your answers. If you are obliged to keep organized accounting, or choose to, a certified accountant must file the declaration.

Three related deadlines from the same pages:

Declaration Deadline Source
Start of activity Before starting; for entities that register at the commercial registry, within 15 days after applying for registration and always before the activity begins AT FAQ
Change of activity 15 days from the change, unless the law sets another period (the brochure says the deadline varies with the type of change) AT FAQ and brochure
End of activity 30 days from the day you stop AT FAQ and brochure

The brochure adds that if you stop one activity to begin a different one, you file a change declaration, not an end declaration.

What if it is a one-off job?

The FAQ says individuals who want to declare an isolated act have, since 1 July 2025, been exempt from filing a declaration of activity, whatever the value. They only issue an invoice or an invoice-receipt, and pay using the payment document obtained when issuing it on the Portal das Finanças. The tax authority’s page on self-employment describes an isolated act as an occasional sale or service with no expectation of it happening again. Do not use that for regular client work.

Which income tax regime applies to a freelancer?

The tax authority’s self-employment page says that if your gross annual income is up to 200,000 euros and you have not opted for organized accounting, you are in the simplified regime. The brochure adds that organized accounting becomes mandatory from the following year if you exceed 200,000 euros in two consecutive years, or in one year by more than 25 percent, and is optional below that. You can opt for it in the change declaration, by the end of March of the year you want it to apply.

In the simplified regime not all income is taxed. The page says a coefficient is applied to gross income, that it varies with the nature of the income, and names the coefficients 0.75 and 0.35. Whoever uses those two coefficients must show expenses equal to 15% of annual gross income to get the full deduction. The page says the deduction automatically counts an amount of 8.54 times the IAS, or the Social Security contributions if higher, and that expenses recorded in e-fatura, rent of property used in the business and staff costs reported to the tax authority also count. Which coefficient fits your activity depends on the activity code, so check the table of article 151 on the Portal das Finanças or ask the tax authority.

Business and professional income is reported in Annex B of the IRS return, which the brochure says is filed between 1 April and 30 June. It is added to your other income and taxed at the general rates. The brochure also says you may owe payments on account of IRS, based on the assessment of the year before last, in three installments due by 20 July, 20 September and 20 December.

For withholding tax the brochure says you must withhold if your income in the previous year exceeded 15,000 euros, or from the moment it passes that figure in the current year. It applies when the client has organized accounting and is done when the receipt is issued. Rates it lists: 23% for professional activities in the article 151 table, 20% for the scientific research and innovation incentive of article 58-A of the tax benefits statute, 11.5% for other service activities or isolated acts, and 16.5% for intellectual or industrial property income and information on commercial, industrial or scientific experience. The brochure says to check these against the law.

Americans filing in the United States on the same income should read whether Americans still file U.S. taxes from Portugal. We did not read the U.S. pages for this guide.

Do you charge VAT as a freelancer?

Not necessarily. Article 53 of the VAT code, as worded by Decree-Law 35/2025 of 24 March, gives an exemption to taxable persons based in Portugal who do not carry out export operations or related activities and whose annual turnover in Portugal in the previous calendar year did not exceed 15,000 euros. Exempt persons cannot deduct VAT on their purchases (article 53, paragraph 3).

The tax authority’s circular letter 25062 of 26 March 2025 and the FAQ add the following:

  • Organized accounting, imports and the goods and services in Annex E no longer prevent the exemption, if the two conditions above are met.
  • It does not apply to someone who is not based in Portugal, even with a permanent establishment or VAT registration here.
  • It does not apply to an isolated act.
  • In the start-up year, you state in your declaration an estimate of turnover for the current calendar year. When the period is shorter than a year, you do not convert it to an annual figure.

What happens if you go over the limit?

The circular letter gives two triggers. If your turnover in Portugal in the previous year exceeded 15,000 euros, you file a change declaration within 15 working days of the last day of that year and move to the normal regime from 1 January. Its example: an exempt person who invoiced 16,000 euros in 2025 files in the first 15 working days of 2026 (by 22 January 2026) and charges VAT on invoices where the tax becomes chargeable from 1 January 2026. If during the current year turnover exceeds 18,750 euros (the 15,000 limit plus 25%), you file within 15 working days and charge VAT from the invoice that crosses the line.

What do exempt invoices say, and what does the normal regime require?

Regime Invoice wording or duty Source
Special exemption, article 53 Invoice, simplified invoice or invoice-receipt without VAT, marked with the exemption mention (the words regime de isenção after IVA) AT brochure
Normal regime Charge VAT, file a periodic VAT return (quarterly or monthly) by the 20th of the second month after the period and pay by the 25th AT brochure
Article 9 exemption (listed activities) Invoice marked with the mention for article 9 (IVA, Isento, art. 9) AT brochure

The brochure says that the normal regime return is due even in a period with no activity or income. It also says that taxable persons with services to taxpayers in other EU member states may have to file a recapitulative statement, by the 20th of the following month for the article 9 exemption and monthly or quarterly in the normal regime. Which regime you start in is set from the details in your declaration of start of activity.

How do invoices work?

The brochure says to issue an invoice, receipt or invoice-receipt in the Portal das Finanças invoicing system for all amounts received from clients for supplies of services. The same system is available in the ATGO app. Using it removes the duty to report invoice details by the 5th of the following month. Expenses should be validated in e-fatura and assigned to the right sector for IRS purposes. Taxpayers without organized accounting must classify their invoices on the Portal das Finanças for VAT purposes (article 50 of the VAT code, per the brochure).

How much Social Security does a freelancer pay?

The Social Security guide for independent workers (version 1.14, published 16 May 2025) explains the system. Figures below are the ones that guide prints, mostly in 2025 euros.

Enrollment is automatic: the tax authority tells the Social Security Institute that you started activity, and the institute enrolls you and notifies you. For a first-time independent worker the enrollment takes effect on the first day of the 12th month after activity began. You can ask for earlier enrollment: the guide says it takes effect on the first day of the month after the request, or on the day of the quarterly declaration when that is made in a declaration month, and its example shows a declaration made on 16 January bringing enrollment forward to 1 January. The quarterly declaration is made on Segurança Social Direta, which the guide says is the required channel.

How is the contribution calculated?

Step What the guide says
Relevant income From the three months before the declaration: 70% of income from services, 20% of income from the production and sale of goods, 20% for hotel, restaurant and similar services declared as such
Monthly base One third of the relevant income, effective in that month and the next two
Rate 21.4% for independent workers; 25.2% for sole traders and individual limited liability establishment owners with commercial or industrial income
Minimum A contribution of 20 euros a month
Maximum base 12 times the IAS, 6,270 euros in 2025
Option A base up to 25% higher or lower than the declared result, in steps of 5%

The guide’s own example: services income of 6,000 euros in the quarter gives relevant income of 4,200 euros, a monthly base of 1,400 euros and a monthly contribution of 299.60 euros at 21.4%. Where there is no income, or the contribution would come to less than 20 euros, and no base is already set, the base used is the one that produces a contribution of 20 euros. The guide gives the 2025 IAS as 522.50 euros. The 2026 IAS is 537.13 euros under Portaria 480-A/2025/1 of 30 December 2025, so the euro limits above change in 2026; we did not find a 2026 edition of the guide and did not recalculate them.

Freelancers with organized accounting work differently: the base is one twelfth of the previous year’s taxable profit, with a minimum of 1.5 times the IAS (783.75 euros in 2025), set in October for the following year.

When must you declare and pay?

What When Source
Quarterly declaration of income By the last day of January, April, July and October, for the previous three months ISS guide
Correction of a declaration Until the 15th day after the end of the declaration period ISS guide
Late declaration Possible on Segurança Social Direta until the last day of the month before the next declaration period; early enrollment is then not possible ISS guide
Yearly confirmation of last year’s income In January ISS guide
Payment of contributions Monthly, between the 10th and the 20th of the following month ISS guide
Request to switch from organized accounting to quarterly declarations 1 to 30 November ISS guide

Missing the quarterly declaration is a minor administrative offence with a fine of 50 to 250 euros, according to the guide, and late payment carries default interest and is also an offence. The monthly payment details are in your Segurança Social Direta message box. You can pay by Multibanco reference, homebanking, bank transfer, at a Social Security treasury, or by direct debit authorized on Segurança Social Direta.

Who is exempt from contributions?

The guide says some independent workers are exempt even though they are enrolled:

  • Employees with a freelance side activity: exempt on monthly average relevant income under 4 times the IAS (2,090 euros in 2025), if the employer is a different one with no group link, the job gives mandatory cover in another scheme for all the same risks, and the average monthly pay in that scheme is at least 1 IAS. Above the limit you contribute on the excess.
  • Pensioners: old-age or disability pensioners whose activity may legally be combined with the pension.
  • Minimum contributors: in January of the following year, those who paid only the 20 euro minimum the year before because they had no income or low income.

An exemption takes effect from the month after the facts or after your request, and some need a form. The guide also says you stop contributing from the 11th day of a proven temporary incapacity (the first 10 days of sick leave are payable, except for hospital stays and tuberculosis) and during parenthood leave, and that independent workers have protection for sickness, parenthood, occupational disease, disability, old age and death. Unemployment protection applies only to sole traders, owners of individual limited liability establishments and economically dependent independent workers (those who get more than 50% of their income from one client).

The guide also lists people who are not treated as independent workers, including those with temporary activity in Portugal who prove they are covered by another country’s compulsory social protection scheme. They must ask to be excluded with form RV 1025. We did not read which countries qualify, so check before assuming it applies to a U.S. or UK scheme.

Do Americans and Britons follow different rules?

For the registrations, contributions and VAT above, the pages make no difference by passport. What changes is what surrounds the Portuguese rules. Americans have a U.S. filing question on top of the Portuguese return. Britons who lived in Portugal before 2021 are covered in our Brexit guide. Health cover for a self-employed person is dealt with in the healthcare guide.

If your clients are all abroad and you do not plan to register a Portuguese business, the remote work visa guide covers that route. If you plan a company instead of working as an individual, see setting up a company; if you are an employee, see working as an employee; for foreign pay and social security, see remote work for a foreign employer.

What if you stop freelancing?

File the cessation declaration with the tax authority within 30 days of stopping. The Social Security guide says the end of enrollment is done officially from the tax authority’s information and takes effect on the first day of the month after the activity ends. Contributions resulting from the annual review can still be owed.

Official pages read for this guide, all on 18 October 2026: the gov.pt page on opening activity (updated 8 July 2026) and the guide on self-employment (updated 28 September 2026); the Portal das Finanças FAQ on activity declarations, the brochure on starting activity (March 2026), the page on self-employment, article 53 of the VAT code, the FAQ on the special exemption and circular letter 25062 of 26 March 2025; the Social Security Institute’s guide for independent workers (version 1.14, 16 May 2025); Portaria 480-A/2025/1 on the 2026 IAS; and AIMA’s page on the independent worker residence permit.

FAQ

Do I have to open activity before I invoice my first client?

Yes. The gov.pt page says to open activity before starting to work for yourself, at the latest on the day you give as the start date. The Portal das Finanças FAQ says the declaration is filed before the activity starts. One exception: since 1 July 2025 an individual doing a single isolated act no longer has to file a declaration of activity, and only issues an invoice or invoice-receipt.

When do I start paying Social Security as a new freelancer?

The Social Security Institute's guide says the first enrollment in the independent workers regime takes effect on the first day of the 12th month after the month activity started. Where there is no income or the contribution would be below 20 euros, the base is set so that the contribution is 20 euros. You can ask for earlier enrollment through a quarterly declaration.

Do I charge VAT if I earn little?

The Portal das Finanças says a taxable person based in Portugal who did not exceed 15,000 euros of turnover in Portugal in the previous calendar year, and who does no export or related activity, can benefit from the special VAT exemption. In the first year the figure that counts is the turnover you estimate for the rest of that year. Invoices then carry the mention the tax authority prescribes for the exemption.

Can I be exempt from Social Security contributions?

The Social Security guide lists exemptions: for people who also work as employees for a different employer in a scheme that covers all the same risks, for old-age or disability pensioners whose activity may legally be combined with the pension, and, from January of the following year, for those who paid only the minimum the year before. The guide says some exemptions need a request. Read the conditions before you rely on one.

Is the rule different for an American or a Briton?

None of the Portuguese pages we read sets different contribution or tax rules by passport. The differences are around the edges: the Social Security guide lists an exclusion for temporary activity covered by another country's compulsory scheme, and Americans keep a separate U.S. filing question that this page does not answer.
